Rebellion in Supreme Court: Four Senior Judges address the media

January 12, 2018

New Delhi: In a first in India, four senior Judges of the Supreme Court (SC) have gone public against the Chief Justice of India (CJI), telling the media that the administration of the top Court “has not been in order.”

In the unprecedented press conference held at his    residence in New Delhi, Justice J. Chelameswar, who is the top Court’s second-most senior Judge after the CJI, said: “We owe a responsibility to the institution and the nation. Our efforts have failed in convincing the Chief Justice to take steps to protect the institution.”

He acknowledged that it was “an extraordinary event” in the history of any nation. “There is no pleasure in this, we were compelled to do this, the administration of the Supreme Court is not in order,” said the senior Judge.

Speaking on behalf of the four Judges, Justice Chelameswar expressed his lament over the corrosion and compromise taking place within the institution  of the judiciary and especially within the portals of the SC.

The other three Judges by his side were Justice Ranjan Gogoi, Justice Madan Lokur and Justice Kurien Joseph. All four had written to the CJI earlier, Justice Chelameswar said. It is very unusual for serving SC Judges to interact with the media.

“Even this morning, the four of us went and met the Chief Justice and tried to persuade him to accept that certain things are not in order and that he should take remedial measures. Unfortunately, we couldn’t convince him. We all (four judges) are convinced that unless this institution is preserved and (is allowed to) maintain its equanimity, democracy will not survive in this country or any country,” Justice Chelameswar added.

“The hallmark of a good democracy is an independent and impartial judge. The judge is symbolic here, it is an institution,” he said.

The hallmark of democracy is to call a press conference because they could not get the cases they were interested in? I think the government need to investigate their background! There is something fishy! They are not really the true judges but guardian angels of some dark forces! They speak the same language as Congress and communist parties when they say threat to democracy! Rahul and Communists leaders have joined the gang! Soon Laloo and Kejriwaal too will join! Raja and ManMohan Singh will be protesting anytime soon!.
My only doubt when really qualified people have hard time getting a decent job, how come such people get to be in such high places? China or Pak can’t destroy India, but people like these can if they are nipped in the bud!

  2. The real worrying issue from this whole episode is not that there is any truth OR it contains biased allegation with malafide intention. The real reason for worry for all of us is that such so called noble & knowledgeable senior judges of our Great Country could not resolve some issues related to their boss/colleagues and became helpless. See the argument, they wrote a 7 page letter to boss few days back and here they are on the streets of the country asking for a solution. I really doubt their wisdom and how can they deliver justice to the citizens of the country when the they could not solve their internal problem itself. How can Judge’s who are incapable of solving an issue related to their own office, provide justice to country’s citizens. not fit to continue.

Why it took so long for this to happen. The appointment of Judges for this court and other courts are highly politicised, and that speaks about the quality of the democracy in this country which is represented by corrupt institutions. Well done India, after gaining independence and driving the country in a quick sand of corruption.

  4. Paul says:

    7. All communist parties say our democracy is in danger
    8. Malya and Raja too say democracy is in peril.
