Case registered against Hinkal resident for selling MUDA reclaimed land

Mysore/Mysuru: The Vijayanagar Police have registered a case against a resident of Hinkal on charges of selling MUDA reclaimed property to a person.

Kempanayaka, a resident of Hinkal in the city, is the accused.

Kempanayaka is accused of illegally selling a MUDA reclaimed site to one K.N. Harish, a resident of Vijayanagar First Stage. Following directions from a City Court, the Vijayanagar Police have registered a case in this regard.

Vishwanathegowda and Kamaraju, sons of Girigowda of Hinkal, had sold one acre of land coming under Hinkal Survey No. 331/5a to Kempanayaka on Oct. 25, 1999, through an unregistered Sale Deed. But earlier, MUDA on Apr. 1, 1981, had issued the primary notification for acquisition of this land, following which the final notification was issued on Mar. 30, 1984 and subsequently, the land belonged to MUDA.

But the accused Kempanayaka, despite knowing the fact that the land was acquired by MUDA, had sold of a site measuring 60’x 40’ on this land to Harish on Aug. 8, 2006. Later, Kempanayaka, using his political clout, had got the Khata transfer too done in Hinkal Gram Panchayat.

Following a direction from the 4th Additional Senior Civil Judge Court, the Vijayanagar Police have registered a case against Kempanayaka under IPC Sections 406 (Punishment for criminal breach of trust), 420 (Cheating and dishonestly inducing delivery of property) and 468 (Forgery for purpose of cheating) and are investigating.
