Mrs. Anitha Cariappa, former CEO of Ponnampet Co-op. Society, wins the case against her dismissal

Gonikoppal/ Hunsur: A Court in Hunsur has ruled that the former CEO of the Primary Agricultural Credit Co-operative Society, Ponnampet, Mrs. Addanda Anitha Cariappa, who was dismissed from service, be reinstated with benefits.

The then Administrative Board of Primary Agricultural Credit Co-operative Society, Ponnampet, under the Presidentship of Addanda Janardhana, had on 17.10.2014, dismissed the then CEO of the Society, Mrs. Anitha, on certain allegations.

Mrs. Anitha Cariappa had joined the Society 10 years back as a clerk and was promoted as CEO considering her service. But the Administrative Board, observing that Mrs. Anitha’s appointment was illegal and was not as per the rules, arbitrarily removed her from service. 

An aggrieved Mrs. Anitha then questioned the Administrative Board’s decision under Co-operative Societies Act 1959 in the Court of Assistant Registrar of Co-operative Societies at Madikeri. However, the Joint Registrar of Co-operative Societies, Mysuru, transferred the case to Hunsur Sub-Division Court. 

The Court delivered its judgement on 16.6.2020 upholding Mrs. Anitha Cariappa’s prayer and declared the Administrative Board’s decision dismissing Mrs. Anitha from service as null and void. The Court set aside the Board’s decision and directed the Primary Agricultural Credit Co-operative Society, Ponnampet, to pay Mrs. Anitha’s past salary, allowances and other benefits that had been withheld till now. 

Advocates Sajan Kumar Nayak and Jnanesh had appeared for Mrs. Anitha in the case.
