Mysuru: There is a famous saying in Kannada — Hennu, Honnu, Mannu — which means girl, gold and land should all come by itself. Otherwise, you will not get it how much ever you covet it. There are times when even if you get it, it will not reach you. This is what happens sometimes, when one applies for a site in MUDA. In spite of the site being allotted, the allottee may not get it. This was exactly the experience of a family of a school-teacher.
J.K. Nagaveni, a school-teacher, had applied for a site, way back in 1988 (on June 1) at the then City Improvement Trust Board (CITB) now MUDA. Later, she renewed her application during 1990 when MUDA was formed. However, the allotments were made to other applicants. She could not get the site on seniority basis. Subsequently, on Feb. 25, 2001, MUDA allotted the site bearing No. 1595, located at Hanchya and Sathagally B Zone, Mysuru through allotment letter dated Feb. 25, 2001, to Nagaveni.
She waited for the intimation letter from MUDA to make the payment for the allotted site. Unfortunately, MUDA did not issue any intimation letter. Subsequently, Nagaveni passed away on Dec. 12, 2008. To their surprise, Nagaveni’s children J.K. Sheshagiri Rao and J.K. Sushma, both residents of Ramakrishnanagar in city, found the site allotment letter in March 2014 in a trunk. Later, they visited MUDA to enquire about the site allotted but to their shock they found that the site had been allotted to somebody else stating that their mother failed to pay the requisite amount. They also found that the intimation letter had been sent to a wrong address which was returned to MUDA by the Postal Department.
Their request to MUDA officials to rectify the mistake and grant them an alternative site was also declined. With no other option, both Sheshagiri Rao and Sushma approached the District Consumer Redressal Forum.
After hearing the case, the Forum issued MUDA the directive to allot an alternative site within 60 days of the order else pay Rs. 100 per day as compensation. It also ordered MUDA to pay Rs. 25,000 for deficiency in service.
Speaking to Star of Mysore, advocate P.T. Ponnappa, who represented Rao and Sushma, said that his clients would wait for two months for allotment of an alternative site. Failing which he would file an Execution Petition before the District Consumer Forum.
