Mysuru: The High Court (HC) has extended the interim stay order on the Deputy Commissioner’s (District Magistrate) decision, in relation to the reopening of the disputed site to resume Arabic School works at Kyathamaranahalli in city. The HC has directed the authorities concerned to maintain a status quo in this regard.

A Single-Judge Bench of Justice M.G. Uma promulgated the order, following a hearing held on May 6, on the writ plea filed by Huliyamma Temple Trust. Justice Uma has issued the order, adjourning the hearing, to an unscheduled date.

Initially, the Single Judge Bench headed by Justice M. Nagaprasanna had heard the case on May 2. Justice Nagaprasanna, who was scheduled to go on leave, had issued a interim stay order on DC’s decision, instructing to maintain a status quo over the matter.

The Temple Trust had filed its objections in its writ petition, after the Deputy Commissioner in his decision on Apr. 3, had ordered the opening of the lock of the building to operate the Arabic School by Aleema Sadiya Education and Masjid-E-Siddique-E-Akbar Trust on Site No 1/2  and 1/3, on 6th Cross in Udayagiri (Gayathripuram 2nd Stage – Kyathamaranahalli) under the Fundamental Rights enshrined in Article 30(1) of the Constitution. Following the decision, Akbar Trust had started construction works of the school.

Advocate Madhukar, appearing for Huliyamma Temple Trust had submitted to the Court, a report submitted by the City Police Commissioner Seema Latkar to the DC on Feb. 14. The Police Commissioner had submitted that ‘The disputed site in Kyathamaranahalli is a communally sensitive area, with clashes reported in the past damaging public properties. If the permission is given for Arabic School, the law and order situation will be disturbed.’ Keeping City Police Chief’s report as a posit, the advocate succeeded in pleading before the Court that, the permission for Arabic School may trigger communal clashes again.

Advocate A.M. Bhaskar, the legal counsel for Huliyamma Temple Trust said, with the HC asking to maintain a status quo, any instance of continuing with the Arabic School works shall amount to contempt of Court.
