Bengaluru:  The Karnataka High Court yesterday dismissed the bail petition of Mohammed Nalapad Haris, accused in the Bengaluru pub assault case.

While rejecting the bail, Justice Sreenivas Harish Kumar stated that Nalapad, being the son of MLA N.A. Haris, wielded his muscle power by brutally assaulting the victim, L. Vidwath.

The Court based its verdict on the grounds that the CCTV footage of the incident shows the horrendous atmosphere created by Nalapad and his aides and that there is no guarantee that such people will not tamper with the evidence if they  are released.

The order further states that there are prima facie materials to link Nalapad with non-bailable offences such as Section 306 (voluntarily causing grievous hurt by dangerous weapon)                                                and Section 307 (attempt to murder) of the Indian Penal Code (IPC).

The Judge also stated in his order that the Sessions Court had given cogent grounds for rejecting bail and thus the High Court cannot interfere with the reasons assigned by the Session Judge’s decision.

It may be recalled that Mohammed Nalapad had moved the High Court after the Sessions Court rejected his bail plea.

He is accused of assaulting Vidvat Loganathan at Farzi Cafe in UB city on Feb. 17. Nalapad and his friends had allegedly attacked Vidvat, son of a businessman in the city, for not ‘sitting properly.’ Vidwath, who sustained grievous injuries was admitted to Mallya Hospital, where his attackers followed him there too.
