Mysuru: The Muslim Co-operative Bank Ltd. General Manager Fazlulla Shariff, in a press release has clarified that “Elections to the Board of Management of any Co-operative society/Bank is held after the expiry of the term of office of the present Management under the control and supervision of the Commissioner Karnataka Co-operative Election Authority.

Our Bank’s term of office is to expire on 13-02-2019 has been directed to go for election 03-02-2019 as per the letter received from the Election Commissioner on 07-12-2018  vide letter No.Suchpra/Jam.ni/my-01/2018/990/1.asper the provision of the KCS Act 1959, KCS rules and By-Laws of the Bank.

Mrs G.C  Jyothi Urs was appointed as the Returning Officer of the Election Commission as per the letter submitted to us. She is under the direct control of the Karnataka State Co-Operative Election Commission, only the bank has to assist her in conducting the election under  Section 29 C of the KCS Act.

Accordingly the letter received from the election commission was placed before the board and recorded, further it is resolved and authorized the I/c General Manager of the Bank Mr. Fazlulla Shariff to  assist the election commission.

As per Section 20(2) (a-iv) & (a-v), a member of the bank who fails to utilize the minimum services is neither eligible to vote or to contest the election.

The Management in its sitting dated 29-12-2018 resolved to file writ petition before the Hon’ble High Court on  10-01-2019 and to the Hon’ble High Court is to pleased to grant a interim stay for Sec. 20(2)(a-iv) & (a-v) thus enabling all the members to cast their votes and also can contest the election. But on 19-01-2019 the matter was heard again and final order passed allowing the members to cast their votes and the contesting candidates shall comply with Sec. 20(2)(a-iv) &(a-v).

Circular was issued by the Election Commission to go according to Hon’ble High Court orders (a copy of the circular is attested). Hence the returning officer directed us to prepare a list wherein compliance of Sec 20(2)(a-iv) & (a-v) is done by the contesting candidates- I assure you no wrong has been done as alleged by Shafiulla Baig.”
