Plaint against developer for cheating site buyer

Mysore/Mysuru: A complaint has been lodged at the Narasimharaja Police Station against a builder and developer firm accusing it of cheating Rs. 3 lakh after promising a house site. The complaint has been filed by G. Mohit.

Mohit, an engineer by profession and a resident of Srirampura Second Stage, was promised a house site in 2019 by Sri Sai Guru Raghavendra Builders and Developers. Mohit had approached the firm and had visited its office on Shivaji Road in N.R. Mohalla.

In his complaint, Mohit has stated that Manjunath and Mahesh, who were present at the office when he paid a visit, told him that he would be given a plot after paying the landowner at Old Kesare village under Survey Numbers 32, 33 and 34. They told Mohit that they were forming ‘Deepa Enclave’ in the said Survey Numbers and even took Mohit to the location. At the location, a signboard named ‘Deepa Enclave’ was fixed and Mohit believed them and handed over Rs. 3 lakh and entered into a Memorandum of Understanding (MoU) with the builder. The payment was made in two instalments, Mohit stated in his complaint.

After taking the money, the company neither developed the enclave nor returned the money and when Mohit demanded to return the money, Manjunath and Mahesh gave him a cheque, which bounced. Later, Mohit filed a Police complaint, mentioning the details. A case has been booked under IPC Sections 34 (Acts done by several persons in furtherance of common intention), 406 (Punishment for criminal breach of trust) and 420 (Cheating and dishonestly inducing delivery of property).
