‘SC order binding on all’

Mysore/Mysuru: Former Supreme Court (SC) Judge Justice N. Santosh Hegde has voiced support for preserving heritage structures and carrying out renovations wherever necessary to ensure their longevity.

Sharing his views with MGP’s Bhamy Shenoy, Justice Hegde said that if the Apex Court had directed protection of Devaraja Market and Lansdowne building, there was no question of filing an appeal against the order.

He pointed out that under Articles 141 to 144 of the Constitution, the SC judgement becomes the law of the land and must be accepted and obeyed by all. “There is no question of appealing because there is no higher court in India,” he observed.

When asked whether the Government could seek reference to a larger Bench, he said such a course was possible only under strict conditions and was not easy.
