Yeddyurappa moves High Court over FIR

State BJP President and former Chief Minister B.S. Yeddyurappa yesterday moved the Karnataka High Court questioning the legality of registration of FIR against him by the ACB based on a complaint that he had allegedly misused his official position as Chief Minister to illegally denotify land acquired for Dr. Shivarama Karanth Layout proposed by BDA (Bangalore Development Authority).

The petition is likely to come up for hearing next week. Claiming that the FIR was registered as a result of a political conspiracy and vendette as the ACB directly comes under the Department of Personnel and Administrative Reforms (DPAR) which is headed by the Chief Minister, Yeddyurappa said the ACB is being used to falsely implicate Opposition leaders. The petition also contended that the complainant D. Aiyappa is neither a land owner nor a beneficiary to lodge a complaint with regard to the process of denotification.

The petition also pointed out that the decision to denotify lands are administrative actions. Meanwhile, Yeddyurappa has sought 10 days time to appear before the ACB in connection with the alleged illegal denotification case.

In his letter to the ACB, Yeddyurappa said that he had sought time to gather all facts. He said, he was making efforts to get all the necessary details from various Government Departments under the RTI Act, so that he will be in a position to answer all questions that may arise.
