Case registered against developers for cheating land owners

Mysore/Mysuru: Accusing developers Jayaram Pathak and Srihari Pathak of cheating by not providing seven flats after constructing the apartment building as per the agreement made, city residents have lodged a complaint against the two developers at Vijayanagar Police Station.

The residents, who have lodged the complaint are Shahid Ahmed Khan, his wife Dr. Reshma Usman and Indira Thimmaiah, all residents of N.R. Mohalla in city.

Details: Shahid Ahmed and others had purchased five gunta land in Hinkal Survey No. 200/3D. Developers Jayaram Pathak and Srihari Pathak, who approached the land owners, told them that they intended to construct an apartment on their land. The developers, then made an agreement with the land owners of constructing a 16 flats apartment building and to give seven flats to the land owners and keep the remaining nine flats with them.

The developers then showed the agreement document to the land owners. But at the time of registration, the developers had allegedly taken the selling rights of all the flats and had mentioned the same in the document without bringing it to the notice of land owners.

According to the complaint by Shahid, he and others believed that the registration document would be the same as the earlier agreement document and signed the document during registration.

He has further stated in the complaint that the developers had made an agreement to complete the construction in 18 months but was extended by another six months for which another agreement was done. As the construction was not completed even after six months, the land owners and Pathaks got another agreement document prepared on Oct. 28, 2013.

Suspecting that the developers were deliberately delaying the completion of the construction, Shahid and other land owners went through the agreement documents  during which they came to know that the seven flats belonging to them were sold for crores of rupees by the developers and lodged a complaint. Vijayanagar Police, who have registered a case, are investigating.
