City Advocate helps senior citizen

In another case related to the MUDA,  City Advocate V.R. Raghunathan has helped a senior citizen from KGF recover dues to the tune of Rs. 1,39,408 from the Authority. Raghunathan, in a press release, said that V. Ramaswamy (now 72), had applied for allotment of 30X40 feet site at RT Nagar in Nanjangud, on 21.10.2011, depositing Rs. 38,000 along with Rs. 500 for registration. However, realising that the allotment of site was slim, Ramaswamy, in 2014 approached the MUDA for refund of his deposit. To his surprise and shock when he approached the Accounts Section of MUDA, it informed him that his deposit had not reached the MUDA, to make the refund.

When the efforts to resolve the issue failed, Ramaswamy approached the District Consumer Redressal Forum through his advocate Raghunathan. It found the MUDA negligent and deficient in its service and directed it to refund the amount to the applicant by its order dated 29.01.2016. However, MUDA went in appeal to the State Commission at Bengaluru, which also dismissed it on 23.01.217.

Based on the Execution Petition, filed on behalf of the Complainant, the District Forum ensured that Ramaswamy received the following amounts during July 17, from MUDA — Rs. 38,000 deposited in Canara Bank, Rs. 10,000 compensation for mental agony, hardship, inconvenience; Rs. 3, 000 for negligence and deficiency; Rs. 2,000 for litigation expenses. Rs. 38,908 as interest at 18 per cent from the date of deposit of DD; and Rs. 47,500 penalty for 475 days delay in settlement, after the order, totalling to Rs. 1,38, 408, said Raghunathan in the release.
