Grabbing Govt. land with fake documents case: Court rejects application of plaintiff who claimed the land as his

Mysuru: An application, moved by a man to claim a Government land as his by allegedly creating fake documents, has been rejected by the Court. The Court has ordered that the land in question should not be sold or transferred to private individuals. 

The man, whose application has been rejected by the Court, is L.N. Govindaswamy of Nachanahalli Palya in J.P. Nagar and the land in question is a 13-acre land located in Dattagalli Survey Numbers 82, 52 and 61. 

Questioning the Single Judge Bench’s order, Govindaswamy had moved an application to a Divisional Bench against the State Government and the Mysuru Development Authority (MDA) — earlier Mysuru Urban Development Authority (MUDA). 

Judges D.K. Singh and T.M. Nadaf, who took up the case, ordered that the land in question cannot be sold or transferred to private individuals. 

According to 1970-71 RTC information, 1-acre-and-34-gunta land is in Dattagalli Survey No. 52, 1-acre-and-35-gunta land is B. Kharab land in Survey No. 61 and 161-acre-and-10 gunta land is in Survey No. 82 is mentioned as a lake land. 

But in 1980, fake documents were created in the name of Shergar Lakshma Bhovi (said to be the grandfather of Govindaswamy), the order has mentioned. 

Later, on August 5, 1989, the then Assistant Commissioner cancelled the illegal area of Shergar Lakshma Bhovi.  

In the meantime, the MDA had utilised a part of the 13-acre land in question for development and had deposited Rs. 52 lakh in the name of the Court to be given as compensation. 

Govindaswamy, urging for adequate compensation, had moved an application to the Court and the Judges, who took up the case, heard the arguments from both sides, went through the documents and rejected Govindaswamy’s application. On June 4, the Court rejected the appeal and ordered that the public land cannot be alienated to private ownership.
