Assault case: KSHRC for action against former Mysuru SP

Mysuru: The Karnataka State Human Rights Commission (KSHRC) has recommended Department disciplinary action against Abhinav Khare, who was the Mysuru Superintendent of Police, for allegedly assaulting one person from the city.

The case dates back to March 2015 where a case of assault was booked against Khare at Nazarbad Police Station based on a complaint given by T.C. Rajendra, a resident of Yadavagiri. The complainant has alleged that Khare, as the SP, summoned him to his office and assaulted him on March 8 in connection with the dues he owed Rita, a 55-year-old woman.

Acting on the complaint, the Nazarbad Police had filed a ‘B’ Report (B Report is, as it is generally called, is the report filed by the Police that there is nothing to investigate and the complaint is a mistaken fact as provided under 157(b) of CRPC. Once this is accepted, the case is closed) and Anita Rajendra had approached the State Human Rights Commission.

In his order passed on May 25, 2017, former Judge C.G. Hungund, Member of the Human Rights Commission, stated that Abhinav Khare had no reason or jurisdiction to intervene in the case and he could have asked the complainant (Rita) to approach the Mysuru City Police Commissioner to get her grievance addressed.

While the person who was assaulted and the petitioner (Anita Rajendra) can approach the Courts questioning the Police ‘B Report,’ it is clear that Abhinav Khare has caused mental and physical harm to the victim. The chances of Police filing a ‘B Report’ to favour a higher officer cannot be denied, Hungund has observed. The Human Rights Commission has asked Additional Chief Secretary, Home Department to take Department disciplinary action against Abhinav Khare and submit a report to it within three months.
