Is Chief Justice of India Dipak Misra targeted? If so, why?

At a press conference held on Friday, 12th January  at Justice Jasti Chelameswar’s house in New Delhi, Justices Ranjan Gogoi, Chelameswar, Madan B. Lokur and Kurian Joseph targeted Chief Justice of India (CJI) Dipak Misra. Here is a message that is being widely circulated on social media explaining why the Chief Justice was targeted:

  • Two days back, CJI Dipak Misra ordered a special investigation team (SIT) to reopen 1984 Sikh riots cases and investigate 186 cases related to it.
  • It was Dipak Misra who intervened and ensured that terrorist Yakub Memon is hanged for 1993 Mumbai terror attack.
  • Dipak Misra was appointed by Narendra Modi Government.
  • Last month, CJI Dipak Misra slammed Kapil Sibal when he asked to postpone the judgement of Ram Janmabhoomi case after July 2019.  Justice Dipak Misra is leading the bench which will pass judgement on Rama-Janmabhoomi case.
  • The judges collegium, everyone knows is a part of the “ecosystem” created over the last 7 decades and has always thwarted efforts to let “outsiders” come in the circle. It was this collegium which Modi Government wanted to dismantle through National Judicial Appointments Commission (NJAC)  and wanted that people’s representatives should have a say in Judges Appointment. The entire Judiciary ably supported by Congress derailed the entire activity and refused to comply.
  • The campaign against Dipak Misra, maligning the CJI (a constitutional post) baselessly and asking for his impeachment a day after he ordered reopening of Sikh riots case and is set to pass judgement on Rama-Janmabhoomi case shows the power of ecosystem.

The message also throws light on the other judges who cast aspersions at Dipak Misra.

  • Justice Jasti Chelameswar, Justices Ranjan Gogoi, Madan B. Lokur and Kurian Joseph opposed the government plan to make Aadhaar mandatory. If Aadhaar was made mandatory, crores of benami properties, bank accounts and real estate deals would be exposed.
  • After the press conference, senior CPM leader D. Raja visited Justice Chelameswar’s house and held a meeting. Why did a politician visit the judge’s house? Raja is famous for mocking Hindus and Hindu gods and goddesses.
  • The four judges are supported by people like advocate Prashanth Bhushan who is Left sympathiser and has a heart for Naxalites.
  • All the four rebel judges are supported by Advocate K.T.S. Tulsi.
  • Advocate K.T.S. Tulsi is the same person who is hell-bent to prove Robert Vadra an innocent in land grab and other corruption cases. Tulsi also saved terrorist Devinder Singh Bhullar from hanging and soon  thereafter he was made the Rajya Sabha member by the then UPA Government.

    Judicial system is supposed to be free from any ideological bias. But is it? The battle cry to save democracy by four senior judges of the Supreme Court reminds me of Kurukshetra. But in this battle, we the common people are unable to figure out who are Pandavas and Kauravas. Just because four judges suggested that democracy is at risk in India, let us not get carried away by their prophesy.
    In fact what they have done shows India’s democracy is getting stronger by the day. Despite their outbursts, there were no violent protests in the country. Sane voices like that of Justice Santosh Hegde are giving different versions of the episode. What is happening in India, the largest democracy has important lessons for other countries to learn from.
    At the same time we can also learn from the US, the country which has been the beacon of democracy in the last several decades in human history. Is the Supreme Court of the US completely free from the shackles of ideology of conservatism and liberalism? That is why Republicans did not allow Obama to appoint a judge of his choice to the Supreme Court during the last few months of his office.
    Now the child Emperor, Trump according to Economist (there are many such titles bestowed on this racist president who called Haiti, Ecuador, African Countries as ‘shit hole’ countries) has been appointing judges who are believer in his philosophy. This was the games played during the emergency rule by Indira Gandhi. India needs to develop its own system to make sure that judges should be influenced more by laws and not their ideologies. Of course it is impossible to be free from any bias. But one should try their level best to ensure that such human weakness is kept to the minimum.
    Let us start discussion also on how we can make India’s judicial system to be free from ideological bias while analyzing the reasons for the four judges to come out in the open against the Chief Justice of India, who is just one among the equals as all of us agree.

    As retired SC Judge RS Sodhi said, “These four judges have formed a union. There are 23 other judges as well. This trade unionism to malign the office of CJI is immature and uncalled for. These 4 judges have no right to sit in the highest court and must be impeached.” I agree with Justice Sodhi.

    P.S.: The Congress Ecosystem is in Universities, Bureaucracy, Judiciary and every where you can imagine in this country. We have only the people’s support to dismantle the ecosystem and the filth called Congress which considers this Country it’s inherent property because they have developed that ecosystem which provides it oxygen, day in and day out.
    Because they want media to fight their case, we should have public polls about if their concern is true or political, if majority finds it was just politics, they must be impeached and jailed for making the judiciary a toxic pool.

    Mr Shenoy’s assertion in regards to the protests of those 4 supreme court judges is a lesson to other countries is a fallacy in the extreme. His understanding of US constitution is much to be desired, as the founding fathers there created checks and balances; the appointment of supreme court judges after senate votes for them is one such check. Mr Trump or any president of US, can simply recommend a candidate for the supreme court but the power for ratification of that recommendation rests with the senate, who should vote to agree.. That was what the founding fathers of that country intended. In India, the model chosen is somewhat similar to Britain , in regards to the appointment supreme court judges, but then British supreme court ( which replaces the old Law Lords model of the House of Lords)judges are fiercely independent, and the recent example was their majority judgement disagreeing with the British government position of the legal status of the Brexit referendum; they forced the British Parliament to discuss it and vote to make it legal.
