Hijab is not a part of essential religious practices of Islam, observes 3-Judge Bench; Petitioners likely to move SC
Bengaluru: In a significant judgement, the Karnataka High Court (HC) today upheld the Hijab ban and dismissed various petitions challenging the ban in educational institutions.
The full Bench of the Karnataka HC, comprising Chief Justice Ritu Raj Awasthi and Justices Krishna S. Dixit and Jaibunnisa M. Khazi, said: “Hijab is not a part of essential religious practices of Islam. Requirement of uniform is a reasonable restriction on the fundamental right to freedom of expression under Article 19(1)(a).”
The Court observed that the “Government has the power to pass the Government Order (GO) and that no case is made out for its invalidation.”
“The prescription of school uniform is only a reasonable restriction, Constitutionally permissible which the students cannot object to,” the three-Judge Bench further noted.
The State Government had banned wearing clothes which disturbed equality, integrity and public order in Schools and Colleges.
The Bench said, “All the writ petitions are devoid of merits and are liable to be dismissed. Accordingly, all writ petitions are dismissed and in view of the dismissal, all the pending applications fall into insignificance and are accordingly disposed off.”
The petitioners are now likely to move the Supreme Court (SC). Advocate Shahul said, “We are consulting on the issue. Once the detailed order comes, we will analyse it and move the Supreme Court.”

Hijab is a symbol of this subjugation ,as their me-husbands or brothers walk with suits and have no restrictions. What a barbaric religion! We see these Muslims emigrating to Western countries , to escape from the strict restriction of their countries, and yet dress their women in hijab or even Burkhas.

Now, Saudi, Pakistani and all other Muslims countries threaten India, because of this.
I agree Hijab dressing is a sign of subjugation of women by Muslim men.
Kudos to the Karnataka High Court for passing this landmark judgement. Muslims, the barbarians will appeal to the Supreme Court, and I wish the SC has the courage to uphold this judgement.
It is also time to abolish the special personal laws given to Muslims thanks to Gandhi and Nehru, who were Muslim lovers to the extreme. Gandhi , wanted Jinnah to be the PM of undivided India and forced Nehru and Patel to accept it.

Muslim population in India is second highest in th world after Indonesia, and yet they claim minority status in India! Scandalous.

One could see too many young Muslim girls, even in primary school age ranges, are forced to wear Hijab. They have beutiful shiny black hair, and yet it is covered by a black cloth, and they look in envy at fellow Hindu girls with long braided black hair with shiny ribbons.
Barbaric religion, which I accept. Remove their special status in Indian constitution and abolish the WAKF boards in all states. Force them not to howl their prayers through loud speakers from their mosques.
Yes, Saudi Arbia will threaten cutting off oil. Buy cheaper oil from Russia, there is plenty of it after its import is banned in Europe.
